AFK Furniture (Art for Kids) Terms of Service ("Agreement")

Please read these Terms of Service ("Agreement", "Terms of Service") carefully before using artforkids.net ("the Site") operated by AFK Furniture (Art for Kids) ("us", "we", or "our"). This Agreement sets forth the legally binding terms and conditions for your use of the Site at artforkids.net. By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service. Capitalized terms are defined in this Agreement.

Furniture Orders
AFK Furniture (Art for Kids) offers a variety of ways to place orders. You can order directly through our website www.artforkids.net, give us a call or visit our show room. Regardless of how the order is made, you accept the following terms and conditions. Please read them carefully.

Using the Shopping Cart
Shopping at AFK Furniture (Art for Kids) is very simple and secure. Browse through our website and find the items you like. Once you select an item, click the “add to cart” button and the item is automatically placed in your shopping cart. Once you have all items in your shopping cart, you can proceed to checkout. The final step of the checkout process is to review your order, agree to the Terms and Condition and click on the "Place Order" button. All credit card transactions and confidential information are verified and protected by Authorize.Net, one of the industry leaders in SSL encryption. Phone in Custom Orders
Please call our customer service number at: 800-700-6547 Monday through Friday between the hours of 8 am - 4 pm PST. If no one is available to assist you or if it is after hours, please leave a detailed message and we will return the call as soon as possible. We require a 50% deposit on all orders and confirmation before the building process starts, and full payment at the time of pick-up or prior to delivery. Customized, Personalized and Special Order items are not returnable or refundable. You have up to two (2) business days from the date the order was placed to cancel a custom order and to have the amount refunded. After two (2) business days custom orders are non-refundable. Any change to an order (e.g. finish selection, fabric selection, or other options) must be made within two (2) business days after ordering. Changes made to an order (excluding the purchase of additional products) after two (2) business days will be subject to a Change Order Fee of $50, in addition to the cost of the item or option changed. No offset or credit will be provided for prior options that are cancelled. AFK Furniture (Art for Kids) shall not be liable for changes requested by the customer.

Beverly Hill Store Orders
Please stop by our Beverly Hills Flagship store at 8634 Wilshire Blvd. Beverly Hills, CA 90211, Phone: 310-657-6300 for us to help you design your nursery. We require a 50% deposit on all orders and confirmation before the building process starts, and full payment at the time of pick-up or prior to delivery. Sales Tax
AFK Furniture (Art for Kids) charges sales tax to California residents.

Cancellation of Order
Customized, Personalized and Special Order items are not returnable or refundable. You have up to two (2) business days from the date the order was placed to cancel a custom order and to have the amount refunded. After two (2) business days custom orders are non-refundable.

Changes to Orders
Any change to an order (e.g. finish selection, fabric selection, or other options) must be made within two (2) business days after ordering. Changes made to an order (excluding the purchase of additional products) after two (2) business days will be subject to a Change Order Fee of $50, in addition to the cost of the item or option changed. No offset or credit will be provided for prior options that are cancelled. AFK Furniture (Art for Kids) shall not be liable for changes requested by the customer.

Rush Orders
If a rush is requested by the customer, and we agree and are able to accommodate a rush of the order that order is subject to a 20% up charge.

Sample Sale Items
All “Sample Sale” or clearance items are final sales and sold “AS IS” and with NO warranty. No returns, exchanges, or refunds will be issued. Full payment is required for all “Sample Sale” items.

Backorders
Certain items must be backordered due to limited availability of certain options (i.e. fabric, stain, etc.). If any options require a backorder, customer may select a different option. No cancellations or refunds will be issued for backordered options.

Estimated Time To Build Furniture
AFK Furniture (Art for Kids) furniture is made to order. Lead time is approximately 10-12 weeks and is subject to change without notice. COM orders are not scheduled until the entire required yardage is received; therefore, lead-time begins from receipt of COM, deposits and approval. We do everything possible to assure a smooth and prompt delivery of your order. However, be aware that there are circumstances that may arise and result in a delay in the production or delivery of your items. We do our best to give accurate lead times for each order but estimated lead times are not a guarantee of a specific delivery date. Also note that shipping time for freight items is approximately 2-3 weeks from the time that the items are picked up from our warehouse.

Receiving the Incorrect Item
If for any reason your order does not arrive with the specifications that you selected when ordering, we will replace and reship the order at no additional charge to you. Please notify us within 5 days of receipt and the replacement will be shipped.

Returns
Customized, Personalized and Special Order items are not returnable or refundable. No merchandise will be accepted for return, exchange, credit or repair without a written return authorization from our factory.

Furniture Shipping / Deliveries
Shipping time for freight items is approximately 2-3 weeks from the time that the items are picked up from our warehouse.

Standard Curbside Freight Delivery
Customer agrees to provide adequate assistance to the delivery driver during unloading at the curb of Customer's home. It is Customer's responsibility to un-package the furniture items and move the items into the home. Extra charges will apply in the event the Customer requests the shipment be carried inside the home or office.

Premium In-Home Freight Delivery
The two delivery men will deliver the furniture, carry the furniture to the room(s) requested on the ground floor, setup the furniture and remove the packaging materials from the customer's home.

Carrier-Damage Claims
All claims for damages in transit must be handled between the customer and the carrier. However, we will offer reasonable assistance in settling claims. Please make comments of any damaged product on your Bill of Lading at the time of delivery and file the claim directly with the carrier. We are not accountable for freight damages discovered after the delivery has been made

What to do at Time of Delivery
Take the time to carefully inspect all furniture items shipped, look for any damage that might have occurred in transit. Please make note on your Bill of Lading of all damages at the time of delivery and contact us immediately. Claims against damaged items must be made within 5 days. Claims made after 5 days cannot be accepted.

How to Make Shipping Damage Claim

1. Premium In-Home Freight Delivery
a. Inspect all furniture items upon delivery while the freight company is still at the delivery site.
b. Make note of all damage on your Bill of Lading (shipping documents).
c. Take photos of the damage and of the packing material.
d. Contact us immediately 800-700-6547. Send photos and a written description of the damage to us. Claims against damaged items must be made within 5 days. Claims made after 5 days cannot be accepted.

2. Standard Curbside Freight Delivery
a. If you are there at the time of delivery, inspect all furniture items upon delivery while the freight company is still at the delivery site. Make note of all damage on your Bill of Lading (shipping documents). Take photos of the damage and of the packing material. Contact us immediately 800-700-6547. Send photos and a written description of the damage to us. Claims against damaged items must be made within 5 days. Claims made after 5 days cannot be accepted.
b. If you are not there at the time of delivery or are not able to inspect all item before the delivery company leaves, inspect all furniture items to the fullest. Make note of all damage on your Bill of Lading (shipping documents) that you are able to see. Take photos of the damage and of the packing material. Contact us immediately 800-700-6547. Send photos and a written description of the damage to us. Claims against damaged items must be made within 5 days. Claims made after 5 days cannot be accepted.

If the damage is minor, you may accept delivery with the damage noted on the bill of lading. Depending on the situation, either a touch up kit will be sent to you or a professional furniture medic will be arranged to repair the damage. If you choose to accept a damaged item, please retain all packaging to assist in the claim with the freight company.

If the damage is major, you may refuse delivery. The freight company reserves the right to have the piece brought back to us for repair/rebuild. If the freight carrier determines the piece cannot be repaired, another piece shipped out to you as soon as possible.

We will be unable to assist you in the repair or replacement of damaged goods if the above procedures are not followed.

Furniture Release
Full and final payment (including sufficient time for personal checks to clear) is required prior to release of furniture for delivery.

Preparing Your Home for Your New Furniture
Customer assumes full responsibility for sufficient clearing of the area (e.g., doorways, hallways, stairways, etc.) in Customer's home to allow for delivery of the furniture, and reloading/ hook up of any electronic components (as applicable). Customer assumes full responsibility for ensuring that furniture will fit the space, purpose and use intended by Customer. AFK Furniture (Art for Kids) and the delivery company shall not be responsible for moving current furniture or obstructions during the delivery process. Customer's failure to prepare the intended location for delivery, as determined in the sole and exclusive discretion of AFK Furniture (Art for Kids) and the delivery company, may prevent delivery from occurring and therefore result in re-delivery charges.

Furniture Dimensions
Furniture sizes and dimensions are issued by AFK Furniture (Art for Kids) are provided as a service to Customer, and are approximations which should be verified independently by Customer. The measurements provided by AFK Furniture (Art for Kids) are either case width or outer most corners of the pieces. Customer assumes all risk regarding determinations of furniture size and fit. AFK Furniture (Art for Kids) disclaims all representations provided and shall not be liable for any errors in information provided. In no event shall a mistake in size or fit of furniture result in invalidation of an order or refund. All returns will be handled per AFK Furniture (Art for Kids) Return Policy.

Computer Monitor Appearance
Each computer monitor displays colors differently, we cannot be responsible for variations between the actual product finish and fabrics and how it is displayed on your screen. We offer finish samples and fabric swatches for our finishes and fabrics. You may contact us to request a sample or fabric swatch to help you choose the proper finishes for your order.

Finish Variations
Please remember that each piece of furniture is finished by hand with artistically applied colorants and glazes on an individual basis. Wood is a natural material and as such, has variations in grain, color, tone, feel and weight. Therefore, natural variations in these characteristics are unavoidable and will add value to your purchase. Every attempt is made to match our standard finishes but slight variations will occur in grain, color, tone, feel, and distressing. We will not accept customers’ requests for refinishing an item without charge. Custom finishes are available and will carry an additional charge that varies depending on the finish complexity and size of the item. Please submit a sample of your custom finish for a price quote.

Hardwoods
Our furniture is made from wood, a living and breathing product. Because wood reacts to fluctuations in temperature variations and humidity levels, furniture can expand and contract over time depending on the climate. The degree of temperature, humidity or dryness may cause splitting. This will not affect the structural integrity of the piece and is not to be considered defective. It is possible to have different pieces of wood from the same tree with different knots and wood grain. We make every effort to conceal knots and grain on the painted finishes. These knots and grain may eventually bleed through and discolor the light color finishes. This discoloration is not to be considered a defect. We have finishing kits that we can send to our customers.

Fabric Variations
Colors are not guaranteed. Due to color display variation in each computer and screen monitors we have no liability if colors of the product do not match their display on our website. We are not responsible for variations between the actual fabrics and how it is displayed on your screen. You may contact us to request a fabric swatch to help you choose the proper fabric for your order.

Fabrics and Customer’s Own Material
Yardage requirements are based on 54” wide plain goods. Additional yardage is required for pattern matching, plaids or stripes. Unless it is specified on your order as to the correct placement indicating centering, top, side or bottom of the fabric, we will, at our own discretion, make that determination and we will not be held responsible for errors or customer dissatisfaction. AFK Furniture (Art for Kids) does not inspect C.O.M. for flaws prior to upholstery. Clients are completely responsible for inspecting flaws before it is shipped to us. All silk fabrics must have proper backing applied.

Disputes
In the event of a disputed credit card charge, which is ultimately found to have been legitimate or which otherwise finds, in whole or in part, in favor of AFK Furniture (Art for Kids), the customer shall be responsible for all attorneys' fees and costs borne by AFK Furniture (Art for Kids). The terms of any purchase from or dispute with AFK Furniture (Art for Kids) shall be governed by California law, and any litigation arising out of such dispute shall be brought in the State of California, County of Orange.

Forms of Payment
We accept MasterCard, Visa, American Express, Your credit card is charged as soon as your order is placed.

Returned Checks
All checks returned for insufficient funds or other reasons by our financial intuitions are subject to a $35.00 service charge.

Intellectual Property
The Site and its original content, features and functionality are owned by AFK Furniture (Art for Kids) and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Links to Other Sites
Our Site may contain links to third-party sites that are not owned or controlled by AFK Furniture (Art for Kids). AFK Furniture (Art for Kids) has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Governing Law
This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of California, United States, without giving effect to any principles of conflicts of law.

Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.
